Burglary call leads to drug bust

It’s perfectly understandable. You’re the victim of a crime…you’ve been ripped off. Of course you’re going to call the police. You want them to catch whoever did this to you.

But sometimes, you might want to think things through before you call the cops to your house.

Like for example, the Niagara Falls teen who might have been better off cutting his losses. He called police to report a burglary at his home on Lindbergh Avenue….he said someone broke in through a window and stole a safe containing $3,000 that was bolted under his bed.

Okay, I know what you’re thinking….what 19-year-old has a safe with three grand bolted under his bed? Probably one WHO’S GROWING MARIJUANA IN THE BACK YARD. Police discovered the pot plants when they looked out back after neighbors told them they had seen two men in the yard. Of course, since there were eleven pot plants, each of them five feet tall, they would have been tough to miss even if the cops didn’t go out back.

The burglar is still at large, but the teen is now charged with violating public health law for growing marijuana. And parties in his neighborhood just got a lot less fun.

Paterson probe: criticism but no charges

Gov criticized for handling of aide's violence case

AP Photo/Mike Groll, File

COLLEEN LONG,Associated Press Writers
MICHAEL VIRTANEN,Associated Press Writers

ALBANY, N.Y. (AP) — New York Gov. David Paterson will not face criminal charges for calling up a woman who later dropped domestic violence charges against a top aide, though the aide could still face prosecution, according to an investigative report issued Wednesday.

Retired Judge Judith Kaye, tasked by state Attorney General Andrew Cuomo with examining Paterson's role in the assault case, said the Democratic governor's actions did not constitute witness tampering or any related offense.

However, she criticized him for failing to inquire about what actually happened that night beyond the account of his friend and aide David Johnson, and she wrote that he also didn't try to confirm a report that an order of protection was issued.

After the confrontation between Johnson and his then-girlfriend Sherr-una Booker on Oct. 31 in the Bronx, Paterson called Booker and endorsed a press statement that said the run-in was not violent.

"It is hard to reconcile this conduct with the governor's expressed commitment to the cause of domestic violence prevention," Kaye wrote. Her investigation found no interference by State Police, including a trooper who contacted the woman, into the criminal investigation by New York City police.

Paterson declined to comment on the report Wednesday, saying he hadn't read it.

Booker filed a police report saying Johnson choked her, threw her against a mirror and tried to rip her Halloween costume off. After the Paterson call weeks later, she did not show up for court, and the complaint was dropped.

"The evidence reviewed warrants consideration of possible charges against David Johnson relating to the Oct. 31 domestic incident," Kaye wrote.

The Bronx district attorney's office investigation has continued, spokesman Steven Reed said.

Booker's lawyer Ken Thompson said the report showed she never wavered, and "told the truth from beginning to the end."

"All she ever wanted to do, and still hopes to do until this very day, is hold David Johnson accountable for what he did to her," Thompson said.

Even with the announcement that no charges will be pursued against Paterson, the political damage has been done. Buffeted by other ethics questions about World Series tickets, Paterson soon dropped plans to run for a full term this fall, while saying he intended to finish the year in office.

His attorney, Theodore Wells Jr., said that the investigation exonerates the governor of wrongdoing.

Kaye and the state Public Integrity Commission are still looking into whether Paterson illegally obtained the tickets, then lied about it. The commission has a hearing scheduled Aug. 17.

Officials disclosed that Paterson, members of his State Police security detail, and other administration employees spoke to Booker shortly before she was supposed to appear in court for a hearing in the domestic violence case Feb. 8.

The governor confirmed that he spoke to Booker on the telephone the day before the hearing but denied trying to talk her out of pressing charges. He said he just wanted to see how she was doing. Both told Kaye the conversation focused on rumors then circulating about Paterson and press attempts to contact Booker.

The New York Times later quoted unidentified sources as saying that the governor had personally directed two state employees to contact Booker and that he tried to get her to change her story and describe the incident as nonviolent.

Oscar Michelen, Johnson's lawyer, has said his client was never arrested or charged, has remained suspended without pay and looked forward to Kaye's report so he can move on.

He has said New York City police arrived at Booker's home Halloween night and "made a determination there was no evidence a crime had been committed."

Kaye's report said the city officers saw no visible injuries and classified the confrontation as harassment, a violation. She also noted gaps in the legal system that made it difficult for Booker, who was without a lawyer at the time, to file a restraining order against Johnson.

It took the patrol car 90 minutes to respond to Booker's first 911 call, after first going to a car accident and a landlord-tenant dispute because the call was characterized as "low priority." An accidental clerical error by police later wrongly classified the incident as "unfounded," Kaye's report noted.

Police Commissioner Raymond Kelly said Kaye's principal finding regarding the NYPD was that its officers were not unduly influenced and didn't show favoritism. He said they are following her recommendation to examine any deficiencies in the patrol's initial response.

State Police Maj. Charles Day, who headed Paterson's security detail, got a call from Johnson and in turn made three calls — to the NYPD liaison to his detail, the State Police first deputy superintendent, and Booker — before the patrol car arrived at Booker's apartment, Kaye wrote.

Booker testified that Day asked her not to file charges and to let State Police handle it internally. Day denied that, and a friend of Booker's who overheard the call on speaker phone said Day never told Booker not to talk to the NYPD, Kaye found.

Paterson aide Clemmie Harris, a former trooper, acknowledged that he had asked another Booker friend, Deneane Brown, to steer Booker toward "non-interventionist" ways of resolving her dispute with Johnson to avoid media attention, but Brown said she didn't do it, according to the report.

Kaye found no evidence to support a witness tampering charge against Harris or anyone else. She wrote that Day knowingly gave some inaccurate testimony in her investigation but later corrected it, which is a defense against perjury.

He also used State Police computers to see whether Johnson was subject to arrest, and Kaye noted it violates State Police protocol to access a criminal history "without a legitimate investigative purpose."

Day remains the head of the governor's security detail.

State Police counsel Darren O'Connor said the agency will examine Kaye's recommendations about the governor's detail. They include clearer policies on its duties and contact with the governor's staff.

Cuomo appointed Kaye to Paterson's case after critics pointed out a potential conflict of interest because he is also running for governor. Cuomo acknowledged a legitimate argument early in the investigation, before Paterson dropped out of the race.

___

Long reported from New York.

The late Terrell Owens

He's off to a good start

AP Photo/Al Behrman

JOE KAY,AP Sports Writer

GEORGETOWN, Ky. (AP) — Terrell Owens missed his flight but got his number.

When he finally makes it to town — a little late — he'll be wearing his familiar 81.

The Cincinnati Bengals' latest addition missed his overnight flight from the West Coast and had to take a later one on Thursday, delaying his debut at training camp.

The Bengals had planned on him arriving early in the day, taking his physical and signing his one-year contract while the rest of the team held its first workout. They scheduled an introductory news conference after the morning practice.

The news conference had to be rescheduled for after the evening session. Coach Marvin Lewis wasn't sure whether the 36-year-old receiver would arrive in time to work out.

On his Twitter account, Owens posted a note Wednesday night saying he was headed to see a movie. He didn't explain why he missed his flight on Thursday, but confirmed that his news conference had to be rescheduled.

"My Press conf about my "Decision" 2 take my talents 2 Cincy will b held 2nite after 7pm practice!!" he tweeted, playing off LeBron James' one-hour television show announcing his decision to leave Cleveland.

Owens also misspelled Cincinnati in one of his tweets and was quickly corrected by a follower.

"Okayyyyyy I got it now, 2 n's & 1 t! CINCINNATI!! LOL!" he tweeted.

He'll have to make a donation to keep his favorite uniform number.

Receiver Antonio Bryant got No. 81 when the Bengals chose him over Owens in the offseason, giving him a four-year deal. Bryant said after the morning practice that he had already talked to Owens and agreed to give up his number.

"I'm a realist," Bryant said. "I said, 'Hey, man, I'm not going to make no big spectacle about it. You've got a bigger legacy and a number than I do. I've been on several teams like you, but I've changed my number several times. You've had the same number. I don't need your money. At the end of the day, all I want you to do is take care of one of my little league programs in Miami. Send them a small donation and we'll go from there.'"

With Owens late in arriving, Bryant was a focus of the Bengals' first workout — for his knee, not his number.

He had surgery for torn cartilage in his left knee during training camp with Tampa Bay last year. He was limited to 39 catches for 600 yards and four touchdowns. The Bengals signed him to a $28 million deal, hoping he would provide another outside threat with Chad Ochocinco.

Bryant backed off workouts last month because the muscles around the left knee didn't feel strong enough, causing him to be cautious. He went through drills tentatively on Thursday, never running at full speed. He said he would sit out the evening practice to work on strengthening the leg.

"The only thing I'm struggling with right now is just being comfortable and mentally just putting (the left foot) down and doing what I want to do without thinking, 'Oh, I might feel pain,'" Bryant said. "That's my biggest hurdle right now."

Lewis insisted that Bryant's knee problem had nothing to do with the decision to sign Owens this week. Bryant isn't so sure.

"Maybe so," he said. "But it's a business and there's a purpose behind being here and that's winning championships, and right now we look pretty good on paper, I'll tell you that much.

"I'm a team player. It's all about having the best team. If I owned the team, I would definitely go after the best players if possible, especially with the situation they acquired him. I definitely would have went after the guy."

Running back Cedric Benson fully participated in the workout. Benson met last week with commissioner Roger Goodell about his offseason arrest in Texas on a charge of misdemeanor assault. Benson is accused of punching a bar employee, a charge he has denied.

Benson hasn't heard anything more from Goodell, who could discipline him.

"We had a good talk, a good session," Benson said. "I guess no news is good news."

Canada, the not so perfect escape

He didn't even get to see Niagara Falls

Sometimes people just need to get away from it all and go on a short vacation.

At least that’s the line a West Virginia man fed to U.S. Customs officials while trying to re-enter the states.

He had told Canadian border officials that he was trying to find a store using his GPS, which “accidentally” led him to Fort Erie. They bought into the man’s story and allowed him to turn around and return to the U.S.

When confronted by U.S. officials he said “he needed some time away from home”.

Unfortunately for him they quickly found out why he needed that time away. Just one day earlier, a felony warrant had been issued for him in his home state on a charge of sex offenses against a minor.

Which casts some doubt on the GPS accident story.

He was turned over to Buffalo police and will be extradited back home.

At least now he’s saved the trouble of booking a hotel for his little getaway because West Virginia probably has a nice little spot set up for him.

iPhone = pocket porn

Should they add XXX to the keypad?

AP Photo/John Bazemore

JOEL SCHECTMAN,Associated Press Writer

NEW YORK (AP) — It's a maxim of technology: Invent the newest gadget and the porn industry will find a way to cash in.

So when Apple Inc. launched the iPhone 4 and its FaceTime videoconference feature, it didn't take long for adult-entertainment companies to develop video-sex chat services and start hiring workers through Craigslist.

With more than 3 million of the phones already sold, the adult industry stands to make big money on this new way to reach out and touch someone — even if it puts Apple, which has always taken pains to keep its iPhone apps squeaky clean, in an awkward spot.

In at least five cities, Craigslist ads seek models specifically for video sex chat on FaceTime. Many of the ads even offer to throw in a free iPhone 4 for the new employees.

FaceTime lets people call another iPhone 4 user and have live video conversations over a Wi-Fi connection through the phone's camera and screen. In one TV ad, a soldier uses it to get a look at his faraway wife's ultrasound pictures.

The adult industry wants its customers to share moments of an entirely different kind with its stars. And while the technology may be new, the idea is not. Porn providers have always been early adopters.

In the 1970s, the demand for explicit videos at home helped VCRs become widespread, and the industry was the first to embrace DVDs, too. Internet porn peddlers were some of the first to make wide use of streaming video and online credit card payments.

"The first time someone created a camera there was someone who said, 'Wouldn't it be good for someone to take off their clothes in front of this camera?'" said Michael Gartenberg, vice president at Interpret LLC, a media research company.

And for years, cameras mounted on computers have helped connect people for racy online video sessions. But the portability and privacy of a cell phone makes FaceTime a new frontier for the industry.

"A phone is such an intimate thing, you usually don't lend it out or have someone else use it," said Quentin Boyer, a spokesman for Pink Visual, an adult production company.

Boyer said his company began planning for iPhone 4 video services almost as soon as the device hit stores. They should be ready in a matter of weeks. Boyer said the company will offer FaceTime sessions with some of the same women who appear in its videos.

"It has a very personal feel — your mobile phone to hers," he said.

Online exhibitionism is only growing. Take Chatroulette, which randomly connects strangers for video chats. While the service isn't explicitly sexual, it's common for users to stumble upon people looking for more than just conversation.

So far, most online video sex chat services have let the customer see the performer, but not the other way around. FaceTime may change that.

"We are seeing more and more that customers want to be watched as much as they want to watch," said Dan Hogue, owner of an adult chat company called CamWorld, which is planning FaceTime services.

The rise of FaceTime porn puts Apple in an awkward position. Its competitors have products that allow video chat, too — HTC's Evo 4G phone, for one. But Apple has made a big deal about keeping applications sold in its iTunes store clean.

Apple has rejected book apps for featuring sexual content and political satires for their potential to offend. While some rejected apps have been approved after revisions, Apple has kept one strict rule: No porn.

FaceTime isn't even an outside developer's app. It's a main feature of the phone.

An e-mail attributed to CEO Steve Jobs that was posted on technology blogs in April says it is Apple's "moral responsibility" to keep pornography off the iPhone. Apple would not confirm that Jobs wrote it.

But just as Apple can't control whom iPhone users call, the company will have a hard time dictating how FaceTime is used. Internet experts say customers will understand that Apple cannot control what goes on in private video chats.

"Apple can't be seen as responsible any more than makers of routers or hardware are responsible for the content you are looking at," said Jonathan Zittrain, a co-founder of the Berkman Center for Internet & Society at Harvard University.

Still, advocacy groups worry that FaceTime could connect children to pornography or predators. Parents can put computers in public areas of the home to supervise Internet usage, but mobile phones go anywhere.

"Unfortunately, both children and sexual predators are often ahead of parents when comes to technology," says Donna Rice Hughes, president of Enough Is Enough, a child safety group.

Apple, asked to comment on the emerging adult services, noted that people can choose whom they chat with, just like regular calls, and parents can turn off the FaceTime feature. Hughes said it would be better if parents could create a "safe list" of people their children could call.

For the adult-entertainment industry, FaceTime could be more than just another medium. It could actually change the business. For independent sex-chat workers, for instance, it could mean handing over less of their earnings to computer-based services.

But FaceTime presents its own challenges. It requires that both parties in a chat have each other's phone numbers, which could expose video-chat workers to unwanted calls from their clients.

Another obstacle: The iPhone 4 camera was designed specifically for face-to-face chatting.

"You can have the phone on your face, or other body parts, but not both at the same time," said Teagan Presley, who acts in adult films and performs in video chats. "Most customers want the full package, and it's going to be difficult holding a phone."

Is your smart phone watching you?

There's an app for that

AP Photo/Kin Cheung

JORDAN ROBERTSON,AP Technology Writer

LAS VEGAS (AP) — Your smart phone applications are watching you — much more closely than you might like.

Lookout Inc., a mobile-phone security firm, scanned nearly 300,000 free applications for Apple Inc.'s iPhone and phones built around Google Inc.'s Android software. It found that many of them secretly pull sensitive data off users' phones and ship them off to third parties without notification.

That's a major concern that has been bubbling up in privacy and security circles.

The data can include full details about users' contacts, their pictures, text messages and Internet and search histories. The third parties can include advertisers and companies that analyze data on users.

The information is used by companies to target ads and learn more about their users. The danger, though, is that the data become vulnerable to hacking and use in identity theft if the third party isn't careful about securing the information.

Lookout reported its findings this week in conjunction with the Black Hat computer security conference in Las Vegas.

Lookout found that nearly a quarter of the iPhone apps and almost half the Android apps contained software code that contained those capabilities.

The code had been written by the third parties and inserted into the applications by the developers, usually for a specific purpose, such as allowing the applications to run ads. But the code winds up forcing the application to collect more data on users than even the developers may realize, Lookout executives said.

"We found that not only users, but developers as well, don't know what's happening in their apps, even in their own apps, which is fascinating," said John Hering, CEO of the San Francisco-based Lookout.

Part of the problem is smart phones don't alert users to all the different types of data the applications running on them are collecting. IPhones only alert users when applications want to use their locations.

And while Android phones offer robust warnings when applications are first installed, many people breeze through them for the gratification of using the apps quickly.

Apple and Google didn't respond to requests for comment on Lookout's research.

Legislative losers

New York is not in a happy state of mind

So our state legislators are heading back to Albany for a special session tonight. If you’re like most New Yorkers, you’re not exactly confident that they’ll get much done. In fact, if you’re like most New Yorkers, you really don’t want them in Albany at all.

A new Quinnipiac University poll isn’t the most encouraging news for incumbent state lawmakers in an election year. Only 35 percent said their incumbent State Senator should be re-elected. 53 percent said almost everyone in the Senate, including their incumbent, should be thrown out. When the same question was asked about the Assembly, the numbers were nearly the same….33 percent favored re-election, 49 percent said throw the bums out.

And when it comes to the job the state legislature is doing….voters feel about the same way Bills fans did about Dick Jauron. 74 percent disapprove. Only 16 percent approve. Which is probably 16 percent more than they deserve.

And 75 percent agreed that New York State government is dysfunctional. So apparently 25 percent of state voters are idiots.

The poll also looked at the statewide races in this year’s election. And there’s no surprise in the governor’s race….Andrew Cuomo pretty much crushes either Rick Lazio or Carl Paladino. But in a poll of Republicans, Paladino is closing the gap on Lazio....the numbers there are 39 for Lazio and 23 for Paladino, compared to 46-17 in last month’s poll. So much for the whole pornographic/racist/bestiality email thing.

In the race to replace Cuomo as Attorney General….not only do voters say they don’t know who they’ll vote for….they also don’t know who the candidates are. That’s not good.

The poll also looked at giving the Attorney General more corruption-fighting powers, and how Governor Paterson and Senators Schumer & Gillibrand are doing. If you want to see all the details of the poll, click here.

As for what happens (or doesn’t happen) at the special session....we'll keep you posted.
